Doug Dicks Brentwood Bay Help oppose the marina expansion Editor: We know that Sidney council is saddled with decisions made by the previous mayor and council whereby they agreed to make application for the extension of the Marina without consultation of the public and upland owners adjacent to the marina. The whole process of the estab- lishment of the breakwater and marina was done behind closed doors with no input allowed by the public. The original petition against the placement of the break- water signed by 65 upland prop- erty Owners was completely ignored. Upland property owners on Second Street, Third Street, Roth- say, Shoreacres, Wildflower and Surfside have been subjected to enough abuse from blasting, pile driving, dredging and dumping during the first phase of this marina. The marina operators have been very lax in policing the owners of boats in the marina, as most any evening water from sinks and toi- lets are flushed into the bay. This past winter approximately one-third of the boats moored in the bay were liveaboards. The operators have allowed a boat to be stripped, with the old paint allowed to fall into the water. This. marina, we were told, was to be moorage only, not a repair marina. It’s all very well for the opera- tors to say that the repairing and paint stripping of boats will not happen again but it did happen, We have been told by expert authority that only the top ten feet ‘of the northerly one-third of the water contained within the marina flushes; the southerly two thirds does not flush at all. The ecology of the bay has been | completely destroyed, where once Sidney had the only sand beach for miles around, we now have a sand bar completely covered with a thick oily scum (we had herons, ducks, otters and numerous shell fish in the bay, now it is dead). For years, at the summer low tides many people walked the beach from Rothsay across to Bea- con Avenue. You can’t walk now even in gumboots. The residents along Second Street and up to 9977-Third have virtually lost their riparian rights due to the dredging of the present marina and in this regard I urge you all to review the Province Of B.C, “Riparian Rights and Public foreshore use in the administration of Aquatic Crown Land” occa- sional paper Number 5 (see pages 3, 6, 12-18, 20-21). We do not intend that our ripar- ian rights be subject to further dereliction and if need be we will - have no recourse but to ask the courts fora decision on the matter. During the past four months only two-thirds of the marina berths have been occupied. We understand that some of the mar- inas in Tseycum Harbour have permanent berths available even at this date. We therefore urge the council to set aside the rezoning application and withdraw the application for a licence of occupation over the northerly portion of the waters contained within the breakwater.
