Court rules against province in
Dean Park water tower decision

The B.C. Supreme Court has
ruled that the Ministry of Parks
was wrong in disallowing a mil-
lion-gallon water reservoir to be
built on one-acre of land in John
Dean Provincial Park.

Justice R.S.K. Wong awarded
the Saanich Peninsula Water Com-
mission, represented by the Capi-
tal Regional District, $1.614 mil-
lion in damages plus interest.

allow the water tower to be built in

sion in the original deed left by
John Dean when he dedicated the
park.

“Tt would be virtually invisi-
ble,’ Westwood said. “Now the

where.”

Westwood said that building the
reservoir outside of the park, south
into Central Saanich, would result
im the destruction of more trees
and would be more of a visual
pollutant.

cern was with water lines that
would run from the reservoir

“What happens is the water
lines go out in all directions and °
scar the landscape,” Greenwood
said.

The Friends have drafted a for-
mal letter and sent it to the Minis-
try of Parks exploring options in
dealing with the damages the court
assessed.
