However the school district has not been able to confirm through the federal Native Affairs office that any land claim has been filed on the site, board vice-chairman Graham Hill said Tuesday. Although’ Tsartlip Band legal counsel Louise Mandell told the school board a specific site land claim was filed with the native affairs office on Oct. 9, the board has not been able to obtain details on the land claim, he said. : A title search done on the prop- erty at the time of purchase shows it was created as a Crown grant in 3 @1858, purchased by A. Verdier in 1875 and owned privately by four owners until 1942, when it was sold to the Crown. New- ton Middle School in Central Saa- nich. “The only intention of the Board of School Trustees for School District 63 has been and continues to be the urgent need for the replacement of the Mt. Newton Middle school,” Hill said. “The Board is of the opinion that the needs of the community are ciitical in this regard.” The overcrowded Mt. Newton Middle School is located between an expanding gravel pit and increasingly busy road leading to a nearby industrial area, Hill noted. After the Gowdy Road property was purchased. the board had to make two applications to the Agri- cultural Land Commission before the property was released from the land reserve for a school site. One of the conditions of releas- ing the property from the reserve was construction of a $250,000 berm between the school site and adjoining agricultural land plus building of an on-site access road. That work was done on the site in August, 1989. Hill said public hearings on the property were held before the land was rezoned. After the land com- mission rejected the first applica- tion to use the site for a school, the board did try to find an alternate site, Hill said.
