Courts Airport jokes Third conviction leads to jail cosily An airport security checkpoint is no place for jokes, three people learned in Sidney provincial court Thursday. Philip Stacey, 30, of Duncan, Marie Gagnon, 19, of Quebec and Mark MacKenzie, 58, of Victoria, all pleaded guilty before Judge Wayne Smith to contravening the Aeronautics Act by claiming to have an explosive or weapon while passing through an airport security check. Federal crown counsel Kenn Kardish said Stacey carried a heavy suitcase into the pre-board check area just after 5:30 p.m. August 31. Putting down the suitcase, Sta- cey said he had a heavy bomb inside. Later he admitted the state- ment was a joke. Kardish said the usual fine for such offences is $300 to $500. “Tt was an incredibly stupid and irresponsible thing you said,” Smith remarked, ordering Stacey to pay a $400 fine. Gagnon, a member of the armed . forces, triggered an alarm when passing through the metal detector at the airport. She was asked to submit to a wand search and a novel she was she was carrying was examined by security staff, Kardish said. As a security officer was look- ing through the book, Gagnon said, “the gun is on the other page,” Kardish explained. An officer representing Gagnon said the woman is 19, has been in the service for a year and is now attending college in Quebec. Judge Smith fined Gagnon $300, remarking, “It is incredible for a person in the armed forces to make such a statement.” McKenzie had emptied his pocket and yet a hand-wand was still detecting metal during a search Oct. 2, defence lawyer Richard Law told the court. Asked what he had in his now empty pocket, McKenzie said “a Another check revealed a lozenge wrapped in tinfoil was responsible for triggering the alarm, Law said. His client was on a business trip to Vancouver and was attempting to be jocular as his pockets were empty at the time the question was asked. “Tt was a serious lack of judg- ment,” Judge Smith said, impos- ing a $300 fine.
