News TheReview Wednesday, October 3,1990 — A16 Two men fined affer late-night stand-off outside store A late-night stand-off between two Sidney men and visiting hoc- key players resulted in a $250 fine for Paul Renee Desjardins, 23, _ found guilty of mischief, and a $300 fine for Walter Andrew Brown, 21, found guilty of uttering threats. Both men pleaded not guilty to the charges but were found guilty by Judge Michael Hubbard follow- ing a trial in Sidney provincial © court. A Victoria man testified that he and two friends had stopped at the 7-Eleven store in Sidney at about 1 a.m. Sept. 30, 1989, following a late-night hockey game at the Panorama Leisure Centre. They noticed a group of six or seven people drinking beer in front of the store. One of the group, Desjardins, threw a half-full beer can over his back at the car. The can dented the hood, the man testified. The Victoria group drove away, flagged down a police car and reported the incident. After the police arrested Desjar- dins and left, another member of the group, Walter Brown came up to the group, started to apologize and then began threatening those in the car. He claimed to be part of a satanic cult and said he would kill those in the car or have a Van- couver gang kill them, one witness testified. The car owner said he took the threats seriously enough to sell his car, rather than have his wife driving the identifiable vehicle in downtown Victoria. A police constable saw Brown write down the licence number of the Victoria group’s car. Desjardins said he was drinking his last beer and was trying to kick the can from foot to knee when it landed on the car A 7-Eleven employee testified those in the car and those on the sidewalk were exchanging insults. Defence lawyer Mayland PLAN TO GET OUT ALIVE McKimm suggested the incident should not have led to criminal charges. Hubbard found Desjardins § guilty of mischief, saying the empty beer can described by Desjardins would not have dented the car hood. ~ He fined Desjardins $250 plus a $37.50 victim’s indemnity charge and placed him on probatigg.. for 12 months.
