Courts / News *Man acquitted of impaired } A 29-year-old Victoria man was not impaired when he was arrested, despite later breathalyzer readings over .08 per cent, Judge Robert Greig decided in Sidney provincial court Thursday. Greig acquitted Allan Robert Woolridge on two charges — driv- ing with a blood-alcohol reading over .08 per cent and being in care and control of a motor vehicle while impaired. A doctor called by defence law- yer lan Morley testified that Wool- ridge would have had a blood- alcohol reading between .03 and 07 when he was stopped’ by Sid- ney police at 10:15 p.m. The doctor based his testimony on Woolridge’s height, weight and the six-and-a-half beer Woolridge admitted drinking between 5 and 10 p.m. that day. By the time Woolridge was given a breathalyzer, his blood- alcohol level could have climbed to the point recorded in the test, the doctor said. Morley noted a description of Woolridge’s condition by the arresting officer indicated Wool- ridge showed little sign of impair- ment. Woolridge said he had taken a friend and two children to Elk Lake while test driving a van he had repaired. Boot bandit billed $100 A youth who nabbed a pair of cowboy boots from a truck camper outside the Spring Water Lodge on Mayne Island paid the price in Sidney provincial court Thursday. Judge Robert Greig fined the first-time offender $100 after the youth pleaded guilty to theft. The theft was reported to police at 9 am. June 14, Crown counsel Edward Ormheim said. At 4:45 p.m. police spoke to the 16-year- old youth and a friend, saying identifiable fingerprints were found inside the camper. The youth admitted the theft, returned the boots and asked police not to tell his grandparents what had happened. Defence lawyer Tom Irwin said the youth lived with his grandpar- ents on Mayne Island for several months and now lives in Victoria.
