People who injure police can usually expect to go to jail, Judge Stephen Denroche told Brian Gor- don, 19. But because of Gordon’s job, and support of a common-law wife and a three-month-old child, Denroche chose a suspended sent- ence instead. He placed Gordon on nine months probation, ordered him to pay $25 restitution to the assaulted officer and to do 60 hours of community service work. Gordon spent one night in jail after the June 4 assault, which occurred when police attempted to break-up a party in Gordon’s base- ment suite. The day before, Gor- don had been given one day's notice to leave the apartment. Denroche dismissed a charge of mischief, saying there was no evi- dence Gordon was responsible for damage to his landlord’s van and truck. During the party, more than $1,000 damage was done to the van, the landlord said. He called police to quiet the party because his wife has multi- ple sclerosis and is harmed by stress, he added. The couple live on the main floor of the house above the basement suite rented by Gordon: Gordon said he suggested the eviction party to friends as a joke after his landlord gave him and his common-law wife one day to vacate the basement suite. ® The ° amazing SAANICHTON Moose Hall 7925 E. To Gordon’s surprise, people began showing up for the party at 10:30 p.m. June 3. The landlord said he evictcd the couple because Gordon had smoked in the non-smoking suite and because the rent for June was not paid by June 3. He called police three times to quieten the party. At about 2:30 a.m. police came for the third time, arrested Gordon and dispersed the party, the landlord said. RCMP Const. George Garbutt said he and another officer were trying to put a struggling Gordon into the police car when Gordon punched Garbutt in the mouth. Repairs to Garbutt’s two broken teeth cost $1,225. All but $25 was covered by the detachment. Gordon said he was trying to escape from a choking neck hold and did not recall hitting Garbutt. He also said the landlord, standing at an upstairs window, was carry- ing a gun. “T was pretty drunk,” he added. He was arrested and spent the night in the Saanich police lock- up. “They kicked me out at 6 a.m. and said, “Walk home’,” Gordon said. He had no shoes and was not allowed to use the phone in the police station, he said. Defence lawyer Jacques Gaboury said Gordon was only trying to escape the choke hold and did not intend to strike Gar- > Hook a Fly in Fishing Trip for 2!
