Wet fiberglass resin inside the hold hampered the rescue effort. Apparenily Merrifield fell after a piece of plywood he was walking on collapsed, about 12:18 p.m. Wednesday. He was treated and released from hospital. Denroche dismissed a defence claim that police did not have sufficient grounds to suspect impaired driving. He found Peter Westman guilty of driving with a blood-alcohol reading over .08 per cent. “7 hardly think the telephone pole was in the wrong,” the judge said. He fined the 28-year-old Victoria man $450 and suspended his licence for a year. A Central Saanich man said he heard the sound of a crash about 5:30 p.m. July 17. Running to the scene, he saw a brown van in the ditch and Westman, in the driver’s seat, reaching over the console for a cigarette. Constable Peter Snell of Central Saanich Police Department said Westman admitted drinking about three pints of beer before the accident. The man said he had been in the hotel from 12 noon until 5 p.m. Westman told police the accident occurred when he leaned over to light a cigarette. Westman gave two breathalyzer readings of .14 per cent. He has no previous record. Defence lawyer Harold Rusk said his client lost a van valued at $3,000 which was used in Westman’s floor-laying business. Rusk suspected Westman would also be charged for the damage to the pole.
