The first is a letter from Alderman Davis, the second a precedential court ruling tendered. by Municipal Clerk Ted Fairs: Editor, The Review, Sir: The agenda called for council consideration and action on two zoning by-laws, No. 113 for adoption, relating to rezoning to light industrial, and No. 116 for reading, relating to rezoning to inn-zone. For reasons should not be brought to a vote, form, both of these by-laws would be amendments to our basic zoning by-law. In the back of my _mind, I recalled that the Municipal Act does not allow a zoning by-law to be amended or repealed except by affirmative vote of two thirds of the Council. Since only three aldermen were at the meeting I queried whether we hada quorum for this pur- pose. The Mayor referred the matter to the Clerk, Mr. Fairs, who stated that we had the necessary quorum. A vote was therefore taken’ on By-law No. 113. The mayor then ruled that we could not vote on By-Law No. 116 because Alderman Horth had not been present at the hearing. I protested this ruling because in my six years on Council, I and many other members have at one time or another been unable to attend and never have we ‘been although it was on the agenda. To me this was a newly concocted rule having basis neither in law nor in precedent. : Returning home I consulted the Municipal Act, and found that under Section 704 ‘‘No zoning by- law shall be amended ---- except upon the affirmative vote of at least. two-thirds of: all the members of the Council’. Since ‘two-thirds were not present, the illegal, and so also would have been a vote on By-law No. 116. Mr. Fairs advice on the question of quorum was incorrect. Under thelaw, neither rezoning by-law could be voted upon, and by calling attention to this I had given the mayor an out if he wanted to avoid a vote on No. 116. There was no need to concoct a silly ruling which had no basis in law, nor to pressure, Mr. Fairs into making off-the-cuff ‘‘in- terpretations’’ of the Act. Legal Comment In the Matter of the Vancouver Charter and in the Matter of a City of .\Vancouver By-law No. 4324 An application was made to quash in part By-law 4324 of the City of Vancouver. The By-law was a zoning by-law. There was no. complaint with respect to notice or conduct of the public hearing. Following the ~ public hearing however, © Council received a letter from Eastern & Chartered Trust Company, written on behalf of persons ef- fected by the re-zoning and containing representation in favour of the rezoning. Council also heard further submissions by the rnembers of the Planning Department of the City, and in addition, members of the Council who. were not present at the vote on By-law No. 113 was in fact Francis.
