Carried. From the Acting City Clerk, November 9th, 1990 regarding Latecomer Charge Waiver Agreement, Citadel Heights Townhouses Genstar Phase 13. Moved by Alderman Laking: Seconded by Alderman Gates: At the request cf and pursuant to the Agreement with Imasco Enterprises Inc. signed the 8th day of November, 1990, BE IT RESOLVED that the works and services described in the aforesaid Agreement and installed or to be installed by the said Imasco Enterprises Inc. in connection with the development of the lands described as: That Portion of Lot 9, Plan 68514, D.L.'s 232, 340, 341 and 344, Group 1, N.W.D., shown on a survey plan signed by Robert M. Reese, B.C.L.S. and dated September 5, 1990 are hereby conclusively deemed to be for the sole benefit of those lands and that none of the cost of providing the said works and services shail constitute “excess or extended services” as defined by Section 990 of the Municipal Act. AND THAT the aforesaid Agreement be and the same is hereby approved and that the Mayor and City Clerk are authorized to sign the same on behalf of the City and to affix the Corporate seal thereto.
