RECOMMENDATION: ‘That Bytaw No. 2062 be read a first three ti BACKGROUND AND COMMENTS: The amendments to the City's Bullding Administration Bylaw No. 1298 that would be implemented by Bylaw No. 2062 have been approved by our solicitor. These amendments arise out of comments made by the Supreme Court of Canada in a recent case involving the City of Kamloops Buliding Bylaw. The amendments wiftl have the effect of relieving the City's Building Inspector from a statutory duty of enforcement of the dsylaw but the City's common law duty of enforcement or other duties which may arfse when ft has knowledge of a violation of the bull ding regulations will remain in effect. The changes to be impiemented by the amending bylaw bring its wording more into line with the City's actual practice and the proposed changes have been reviewed and approved by our Building !tnspector, Mr. Nick Chernoff.
