BY-LAW NO. 1380

A By-law to authorize the City to enter into Land ¥se Contract No. 12.
. KHHEREAS the "City of Port Coquitian Zoning By-law, 1969, No. 918"
as anended designates certain areas of land within the zones set out
therein ag "Development Areas";

AXD WHEREAS the lands hereinafter described are satuata within an
area 65 degignated;

Au WHEREAS the Qwmer of the said lands has made application for a
Land Use Contract to authorize works, developnent, and use some aspects
of which are not in conformity with the relevant City By-laws as the
seme apply to the zone in which the said lands ace attuate;

AND WHEREAS the Council has given due regard to the following

considerations:

1. (a) the promotion of health, safety, convenience and welfare of

the public.

{b) the prevention of the overcrowding of land, and the preservation
of the amenities particular to any zone.
(c) the securing of adequate light, air and access.

(4d) the value of the land and the nature of its present and - prospective

use and occupancy. .

(e) the character of each zone, the character of the buildings

already erected and the peculiar sultadilicy of the zone for particular

the conservation of property values.

the development of areas to promote greater efficiency and

the impact of development on present and future public costs.

and it is deened desirable co enter into Land Use Contract No, 12
ia the form and to the extent hereinafter provided; ,
NOW THEREFORE the Municipal Council of The Corporation of the City

of vort Coquitlan, in open meeting assembled, enacts as follows:

i. The Council of The Corporation of the City of Port Coquitlen is

hereby authorized and enpowered to enter into a-Land Use Contract vith.

Schedule. hereto annexed and made part ‘of this By-law,

. 2. -The said Land Use Contract No. 12 shall extend to and shall regulate

the developuent ald use of the lands described as?

North 128" Lot 12, Block 4, District Lot 379, Group One, Plan

1213, New Westminster District

Land Use Contract No, 12 shall have the force and effect of a
restrictive covenant running with che land described in Section 2 hereof
and shall be registered in the New Westminster Land Registry Office by
the City. :
4. This By-law may be cited for all purposes as "Land Use Contzact No. 12
Authorization By-lav, 1975, No. 1380".
