October 25th, 1976 the Surveyor General was one foot in 2500 feet ~ now upgraded to one foot in 5000 feet. Alderman Ranger pointed out that a degree of tolerance is permitted in the measurement of land due to various factors such as temperature, terrain, etc., and he appealed to the Council to consider the West half of Lot D to be one acre. Moved by Alderman Ranger: Seconded by Alderman Keryluk: That the property located at 831 Prairie Avenue, legally described as the Ws of Lot D, NE Section 6, Township 40, Plan 9737 and calculated to have 43,554.10375 square feet in area, be considered as one acre of land. Carried. Alderman Laking voted against the resolution. Prior to passage of the foregoing resolution, Mayor Campbell pointed out that the By-law requires the minimum size of a parcel of land in an RS-2 (One-Family Suburban Residential) zone to be one acre and allowing the degree of tolerance requested may set a precedent. Mayor Campbell pointed out that a legal alternative would be to rezone the bottom 90' to RS-1 (One-Family Residential) or have a survey carried out to determine the exact size of the subject property. Alderman Thompson stated he was in favour of the application; however, he pointed out that it may be a financial advantage for the applicants to have the property subdivided. Mayor Campbell. stated he would like it publicly known that the City will not accept blame for deciding in favour of the request, and Mr. and Mrs. Moody indicated they agreed to accept approval. on this basis. Alderman Laking, as Chairman of the Planning & Zoning Committee, stated that che decision of the Committee recommending that the property be rezoned to RS~1 (One-Family Residential) was based entirely on the policy set by Council in 1974 and the requirements of the Subdivision and Zoning By- laws; however, Alderman Traboulay stated he was in favour of the application and that he did not see it as precedent-setting. Alderman Keryluk stated that as far as he was concerned, the subject property is the Westerly half of a 2~acre parcel, and that he felt che City had an obligation to allow the applicants to build thereon. Mayor Campbell stated he would like it recorded that the Council has pointed out clearly to Mr. and Mrs. Moody the alternative of subdividing their property and that the decision to approve their request was made on the "tolerance" factor in measuring land; also, a letter was received from an adjoining neighbour of the applicants concerning their request which has not been
