"Soil Conservation

At the Legislature's second session in 1972 an act to amend the Soil Conservation
Act was passed making certain provisions with respect to the removal of top soil from
Agricultural land that is part of an Agricultural Land Reserve and the issuance of
permits therefore by a “Local Authority" and in Port Coquitlam's case this Local Authority
would be the Council.

The Act was not brought into effect until January 30th, 1974 and the regulations
necessary for the operation of the Act were published in Part 2 of the British Columbia
Gazette for February 19th, 1974. <A photocopy of the Act to amend the Soil Conservation
Act and the regulations are attached.

The only immediate requirement is that an Officer must be appointed to enforce and
administer the Act and regulations, subject to the directions of the Council, and this
appointment must be effected before April lst, 1974.

Upon reading the Act and regulations the Council will see that provision is made
for the appointment of "Top Soil Committee" and this is doubtlessly something that the

Council will want to consider in the future.

In order to comply with the provisions of the Act and regulations we would supgest

that the following resolution be passed:

"That pursuant to the provisions of Subsection 1 of Section 4E of the Soil Conservation
Act and Section 17 of B.C. Reg. 77/74 Mr. V.G. Borch, P. Eng., City Engineer, of The
Corporation of the City of Port Coquitlam be appointed the Officer to enforce and
administer Sections 4A to 4p of the Soil Conservation Act and the regulations within the

Cicy of Port Coquitlan;
