December ist, 1975 Administrator advised that nothing illegal has taken place to this point as the house was previously located on the large parcel of land extending right out to Chester Street; however, in order to sell this parcel the Department wants a subdivision so it can dedicate the portion required for road. Alderman Mabbett stated he felt the house re-location was done prematurely; however, Alderman Thompson stated it was his understanding (re-affirmed by the Senior Building Inspector) that as the Department owns the land they can move the house around on the land as they choose - the only thing they won't do whether the house is there or is not there - is dedicate the portion of those lots necessary to construct the Shaughnessy crossing. The City Engineer commented that often properties purchased by the Department of Highways are not cleaned up by subdivision, but a charge is put on the properties at the Land Registry Office that would not show on any registered plan. In this case, they have agreed to build the road as part of the interesection work but this section is not going to be arterial highway -but will instead become City street and it is for this reason that they want to clean up by means of a registered subdivision what they have already done. Alderman Laking inquired why the plan was not submitte3 to Council for relaxation prior to application for subdivision and the City Engineer explained that the plans were received and presented to Council the same as in every other case. Alderman Keryluk stated he would not do anything to jeopardize the construction of Shaughnessy through to Chester and completing the Lougheed-Shaughnessy intersection which is being done for the City's benefit. Mr. Robinson stated he was concerned with respect to Lot 49 as according to his plan the Department is going to bring the highway in there 28' on the existing property line the houses are set in 30' ~ and on the Southern extremity of his property (Lot 48) - they are going to take off 12'; however, they originally told him they were going to take Lots 49-51 and the houses would be done away with entirely. Alderman Thompson commented that the Department of Highways is continuing its negotiations on a person to person basis and to his knowledge the people involved have been reasonably satisfied; further, he stated he was very reluctant to set into discussions between the Department and private citizens.
