Where a survey certificate provided in accordance with section 17 of this Bylaw indicates that a quantity of soil greater than that for which a permit was issued has been removed from land, the permit holder shall: (a) immediately cease the removal of soil from the land and make a new application in accordance with the provisions of this bylaw; and (b) pay to the City the difference between the permit fee paid pursuant to section 13 and the fee based on the quantity of soil actually removed. . This bylaw shall be administered by the City Engineer. _ The City Engineer, the Bylaw Enforcement Officer, and all City employees under their direction may at all reasonable hours enter upon any land or premises in the City to determine if the provisions of this bylaw are being met. No person shall obstruct such entry. Upon written notice being given to a permit holder by the City Engineer or the Bylaw Enforcement Officer, of a breach of this bylaw or of the terms of a permit issued under this bylaw, all removal of soil shall cease until the breach is remedied. Where soil is removed from land without a required permit, the owner of the land shall comply with this bylaw or replace the soil, within 7 days of notice to do so from the City Engineer of Bylaw Enforcement Officer. On default by the owner, the City may replace the soil and the costs of replacement shall be recoverable in the same manner as municipal taxes. Where a breach of this bylaw or of the terms of a permit cause an emergency, including but not limited to deterioration or failure of a water system, sewer system, purification facility, septic field, blockage of a stream or drainage facility or potential danger to public health or safety, the City Engineer may issue an order for immediate remedy of the breach. If the permit holder does not immediately commence and diligently continue to remedy the breach, the Council may revoke the permit. _ The Council may suspend or revoke a permit issued under this bylaw if the permit holder violai. . any of the provisions of this bylaw or any of the terms of the permit. PENALTY 25. Every person who violates any provision of this bylaw or fails to comply with any permit issued under this bylaw commits an offence punishable on summary conviction and shall be liable to a fine not exceeding $10,000.00. SEVERABILITY 26. If any section or lesser portion of this bylaw is held invalid, it shall be severed and the validity of the remaining provisions of this bylaw shall not be affected. 2827 ITEM | PAGE FS
