Brown Director of Community Planning RS-1 and RS-2 Residential Zones Zoning Bylaw Text Amendment RECOMMENDATION: That City Council direct the Clerk's Office to prepare an amendment to the Zoning Bylaw No. 2240, Section 801 anu 802 RS-1 and RS-2 Zones, identifying that only one set of kitchen facilities are permitted. COMMENTS: In a re.ent bylaw prosecution, the City encountered difficulty with explaining to a judge that kitchen facilities are the key variable in distinguishing between a dwelling and boarding. Essentialiy, the City's approach has been fo avoid using any reference to family because of constitutional considerations. The City’s approach, as a number of other municipalities is to use kitchen facilities to define a dwelling. FILE: 0004-16(2)
