Appin Application R#i3-73 to rezone the Remainder of Lot C, D.L. 380, Plan 5969, known R#L3-73 as 2637 Davies Avenue, from RS~1 (One-Family Residential) to CS~-1 (Service Commer~ cial) to accommodate use as an automotive repair shop be rejected for the. following reasons: i) the commercial use would be an encroachment into the RS-1 area; 4i) the Committee noted that new housing is predominant in the ara (as shown on a plan accompanying the report) and that the long range recommendations in the Eastgate Study called for a phasing out of the existing commercial uses in the Davies Avenue area and are replacing with residential development; 4ii) the request would cr2#te a Spot Zone of CSL which would in effect open the property for construction of a service station or tourist accommodation use and a numberof other uses under our present zoning regulations; iv) if approved the application would permit two uses on one property, that is, residential and commercial; v) when the building permit was issued for construction.of the garage-on this site it was clearly indicated to the owner that no commercial, use would be allo- wed, and there is no parking available on the site only a single driveway to the garage; vi) there is a creek adjacent to the garage and if the application was going to be given further consideration it shovld be referred to the Environmental Sub- Committee for their comments on the proposed commercial use adjacent to a creek.
