~ COUNCIL MEMORANDUM NOV 24 1975 Mayor and Council November 21st, 1975 L.D. Pollock City Administrator Re: Midway Attractions for May Day We have been presented with a Contract between M.F. Wagner Shows Ltd. and . the City to cover the.midway rides and attractions for the 1976 May Day. Mr. Lee Kallen would like to have this Contract signed in order to ensure that the Show is hooked for the 28th, 29th, and 30th of May, 1976. The form of Contract is attached and although there are one or two items to be clarified in the Contract, it basically provides for payment to the City of a Guarantee of $2,000.00 or 25% of the Gross take whichever is greater. The Contract is not an onerous one, however, it would be as well to clarify in writing to the firm the following: 1. with respect to item 5 in the Contract, I have pointed out to the Agent that there will be entertainment on the grounds on two deys of the Show and ‘they acknowledge this and are not too concerned about our programme. 2. regarding item 7 in their Memorandum of Agreement, I have pointed out to them that we generally have service clubs operating food concessions on the grounds and these are not permanently located as: described in item 7. The Company has acknowledged that we will be having other food concessions on the ground and they do not object. 3. In view of the fact that the main May Day functions may be held at the Port Recreation Center this year, I have asked the Company about damage to the blacktop parking lot. They advise that they are only required to drive two 4" steel ground rods for their electrical system and they have indicated that it is possible to find a location just off the edge of the blacktop to drive these rods. In spite of this, I have asked him to post a Bond of $500.00 to guarantee that the blacktop will not be damaged due to their operation and they have agreed to this. 4. We will require from them, a copy of their Public Liability Insurance policy. Subject to the foregoing, I would recommend that we enter inte the Memorandum of Agreement with this firm. L.D. Pollock
