Further to our previous correspondence on the issue of a dyke maintenance permit, ¢
staff are not convinced that such a permit is necessary, but on the basis of your posit
that you will not recommend ministerial approval of the dyke construction unless the
is a maintenance commitment which is effective immediately upon completion of
construction, staff are prepared to recommend approval cf the maintenance permit ta
City Council on the following terms:

1. The City’s maintenance obligation will exclude the locatee iand, unless
authority to enter on that land has been confirmed by the date of
completion of construction.

The maintenance permit should be for a one year period from the
completion of construction, which should be more than sufficient to
implement the proposed statutory right of way.

The terms of the maintenance permit will not prejudice the City’s position
with respect to the content of the statutory right of way agreement.

The maintenance permit should be us brief and straightforward as possible.
