12. Nothing in this Agreement shall impair or prejudice the

City in the exercise of its statutory powers, including without

limitation all powers of land use regulation and expropriation.

13. Every reference in this Agreement to the City shail
where the context permits include its successors, assigns,
officers, employees, contractors and agents, and every reference
to the Grantee shall include its successors, assigns, tenants,

licencees and invitees.
