"Mentcipal Engincer™ shall be construed to mean and daciude the City Engineer for the Municipality and his duly authorized assistants or such Consulting or other Professional Engincers as nay be appointed to act for the Municipality. , “Mcaicipal Planner" shall be construed to mean and include the Planning Officer for the Sunictpality and his duly authorized assistants or such Consultants as may be appointed to act for the Municipality. “sork" or "Works" or any variation of these words shzll be construed to mean and include all work required to be done for the setting~-our, the execution and the completion of this Contract to the satisfaction of the Municipality. The Developer -is the holder of a registered interest in ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being in the City of Port Coquitlam, in the Province of British Colurdia, which safd land is described in Schedule "A" hereof and is heredaafter culied "che land. Consents: 3. The Developer has obtained the consent of all persons holding any registered interest in the land as set out in the Consents to the use and development set forth herein, which Consents are attached hereto. Uses: 4. The land, including the surface of water, and any and all buildings, structures and isprovements -rected thereon, thereover or therein shatl be used. for the purpose or purposes specified in Schedule "B" hereto and for no other purpose or Psxposes whatsoever. No building, structure or improvement shall be sited, constructed, reconstructed, altered, noved or extended upon except in compliance with the plans and specifications for the use and development of the land, approvec by the Municipal Engineer, which said plans and specifications are hereby incorporated by reference and forn part of this Contract. ‘No sign shall be erected upon the iend or on any building or structure thereon except in compliance vith the hereinbefore described plans and specif‘cations and further subject to che satisfaction and approval of the Municipal Planner. Parking: Off-street parking and loading spaces shall be provided, _ located and constructed in accordance with the hereinbefore described “plans and specifications and further subject to the satisfaction and approval of the Municipal Planner. Subdivision: 8 No land shall be subdivided except in compliance with and according to the plans and particulars set out in Schedule "C" hereto. Landscaping: 9. All landscaping, surface treatments, fences and screens shall be constructed, located, provided and maintained in compliance with the héreinbefore deseribed plans and ‘specifications and further subject to the satisfaction and approval of the Municipal Planner. Urilities: 10. All utilities, including water, sewer, gas, telephone and electricity shall be placed, provided and constructed in compliance with the hereinbefore described plans and specifications and further subject to the satisfaction and approval of the Municipal Engineer. Application of Provincial Building Code cs li. Except as provided herein all buildings and structures shall be constructed strictly in compliance with applicable Municipal By-laws and the Provincial Building Code. Works, Construction, Desipn, and Security Therefore: 12. (a) To facilitate the use and development of the lané, the Developer covenants and agreos to provide, construct and install such off-site works and Services as are deemed necessary by the Municipal Engineer to serve the land and development thereon and to pay for the eatire cost of the completion uf the aforesaid off-site works and services. The said off-site works and services shall be constructed and completed to the satisfaction of the Municipal Engineer in compliance with and according to plans prepared by the Developer and approved by the Municipal Engincer prior to the granting of necessary ‘approval and occupancy permits by the appropriate Officer of the Municipality, Without limicing the generality of the foregoing these off-site works and services shall include those items set out in Section 1 of, Schedule "D" hercto.
