Exsct coss will only be devermined when concract tenders ars received. : (2) Admintstraticz cf the Contract enc Tespection of the Wert To the extent provided by the concrect berween the Owner end the Contractor, the Architect shell make decisions on ail claims of the Owner and the Contrzctor and on all ocher matters relating to the execution end progress of the work of the interpretation of the Contract Documenss. The Architect will make periodic visits to the site to fam! himself generally with the progress and quality of zhe work, and to determine in general if the work is procesdng in accord- ance with the Contract Documents, During such visits he will not be required to make exhaustive or continuous on-site inspections to check the quality or quantity of the work, end he will net be reeponsib‘e for the Contractor's failure to carry out the construction work in accezdance with the Contract Documents. Cn the basis of his observations while at the site, he will keep the Owner informed of the progress of the work and will endeavour to guard the Owner against defects and deficiencies in the work of Contractors, and he may condemn work as failing to conform to the Contract Documents. (d@) Certificates for Payment: Based on the Architect's observations on the site as noted above, and the Contractor's Application for Payment, he will determine the amount owing to the Contractor and will issue Cernificates For Payinent in such amounts, These Certificates will constitute a representation to the Qwnez, based on such observations and the data comprising the Application For Payment thar the work has progressed to the point indicated. By issuing a Certiicate For Payment, the Architect will also represent to the Quner that, to the best af his knowledge, opinion and belief, the qualicy of che work is in accordance with the Contract Documents, He will con- duct inspections to determine the dates of substantial and final completion, and will issue 6 final Certificate For Payment, {9) Clerk of Works. If constant representation on the job by the Client during the ess of the work is desired by the Cliens, a Clerk of Works, acceptable ro borh the Client end the Architect, shall be engaged by che Architect. His salary shall be approved and paid by the Client, The Architect shall not’be ponsible for any neglect or default of such Clerk of Works. ARTICLE ID. The Client’s Responsibilities, (a) Survesa, Borings and Tests, ete. The Client shall furnish, or reimburse the Architect for procuring, an accurate survey of the building site, including all information and all surveyors services required for the setting ouc of the structure, and giving the grades and lines of streets, avements, adjuining propertics, and structures thereon, the i ti restrictions, eazements, ondaries and contours of or affecting the building site. He shall provide also, cr reiinburse the Atch.tect on account uf direct costs for procuring full information as to sewer, water, g2s, electrical and other public utilities services. The Client shall pay a':0 for borings or test pits end for chemical, mechanical and other tests which may be required, and fur any advertising incident. al to obtaming renders, and for any permits or licences which may be required end for any neces- sary legal service. The Architect shall not be responsible for eusrs or damages srising from errors or omissiens in the provision of any of this information supplied by the owner, (b) Citent’s Decisions. The Clicne shall give due consideration to all sketches, drawings, sperifi- cations, tenders, proposals, contracts and other documents laid before him by the Architect and, whenever prompt sction is necessary, he shall inform the Architect of his decisions in such reasonable time as nat to delay the work of the Architect nor to prevent him from giviny drew- ings or instructions to contractors in due season. ARTIGLE IV. Peovisicns and Conditions, (a) Definition of “Coet of the Work”. “Cost of the Work”, except as hereinafter provided, means che cost to the Clisne of the work and approved additions thereto including Contesetor's profits and expenses but not including Architect's and engineering itant’s fees of the fees of other special consutcanes or reimbursements o¢ the salary of 2 Clerk of the Works. Should laboar or material be furnished by she Client below its market cust or should old materia!s be reused, cect is to de interpreted as the cost of all materials end labour necessary to complete the work as such cost would have been if all materisiz had been new and if all labour had been paid for s¢ market prices current when the work was ordered, ~ (3) (8) Seles Tax Exemption. Paymenc to the Architect for services rendered which fait within Article IV (c) and Article IV (d) shall be made trom ume te time as such work is done. Payment: for d.sbursements which are chargeable co the Client under the provisions of this sgree- ment shail be made promptly by the Client as the accounts for the same are rendered to him by the Architecc. All drawings, specificauon: and documents prepared by the Aschi- tect are instruments of service for the execution of the work and are te property of the i tect whether the work he executed or nor and he reserves the copyewht therein and in the work executes! therefrom and they aze not to be used on any other work withour the written permission of the Architect.
