Three sue Re TWO TOP Skeena Cel- lulose officials, and a for- mer co-worker, are suing their old employer Repap ‘Enterprises for a total of $823,000 in severance pay they say is owed to them following the company’s change of ownership, -The claim stems from clauses in their employment agreements that call for severance of double their annual pay should they be terminated within two years of a change of control of the ” company. That’s exactly what hap- pened last year when Repap Enterprises left B.C. sub- sidiary Repap B.C. in the hands of its bankers, leading eventually to the province buying majority control of the company, which was renamed Skeena Cellulose. The three suing employees are Pat Ogawa and Rand Menhinick, who were top executives based at the Ter- race sawmill, and Tom Boughner, formerly general manager at the Prince Rupert pulp mill, now reas- signed to plan a major up- grade there. Ogawa and Boughner, al- though they now work for Skeena Cellulose, say they -, were terminated from their . jobs with Repap on Nov, 27,- 1997. Ogawa says he’s owed: $250,000 (twice his salary) while Boughner says he’s owed $342,000 ($320,000 of which is twice his salary; the remaining $22,000 is to pay out a vehicle lease). Menhinick, who was terminated earlier and who does not now work for Skeena Cellulose, says he’s owed $230,360 ($216,360 of which is twice his salary and $14,000 for a vehicle lease payout). Named as the defendant is Repap Enterprises Inc. of Montreal, the overall com- pany which used to belong to George Petty, The suit states Repap En- terprises is or was the owner pap for pay Pat Ogawa | of Repap British Columbia Inc,, the company whose as- sets are now called Skeena Cellulose. Repap B.C. fell into court- ‘ordered bankruptcy pro- tection in March, 1997 after Repap Enterprises had walked away from it, after loading it down with debt, Starting a lengthy financial crisis in the northwest which still has yet to be settled. Rand Menhinick The suit was filed in the’ B.C. Supreme Court March 10. The trio say they were asked to formalize employ- ment agreements with Repap in June 1996, provid- ing for the severance amounts should there be a change in control of the, company within two years. They also want their legal fees covered by Repap. CFNR returns to carrying CFMI THE ON again and off . again saga of the ability of a northern radio station to carry southem programming appears to have come to a conclusion. CFNR is once more carry- ing the Rock 101 CFMI sig- nal from Vancouver be- tween 6 p.m, and 6 a.m. and on weekends. The station pulled the sig- na] for one night last week after competitor Skeena Broadcasters asked the Ca- nadian Radio-television and Telecommunications Com- mision (CRTC) to appeal what CFNR is doing, But the CRTC, which regulates radio stations, quickly told Skeena Broad-. casters there was nothing to appeal. In a letier to the private broadcaster, the CRTC said conditions of CFNR’s exist- ing licence were sufficient for it to pick up CFMI. The station heard just two weeks ago it could carry CFMI and began to do so when it was told Skeena Broadcasters asked for an appeal. — “We didn’t know what was going on,’’ said Martin prior to the exchange of cor- respondence between the CRTC and Skeena Broad- casiers. CENR first began carrying CFMI last fall, without the benefit of a licence in- tepretation from the CRTC. Skeena Broadcasters protested then and the signal was pulled while CFNR sought CRTC approval. That approval was received the end of Febru- ary, giving CFNR the green light — until the request for an appeal was filed by Skeena Broadcasters.
