RE: Boutcher v. The Corporation of the City of Port
Coquitlam et al ~- S.C.B.C. Vancouver Registry
Action No. B883294

Further to our telephone conversation of March 8th I am
able to confirm as follows. . .

My instructions are that the Ministry of Transportation
and Highways has no present intention to request the
return of the Bailey components until either the use of
the road is discontinued or the City erects a new
structure. However, in terms of a firm commitment my
instructions are only to extend a guarantee of continued
use for a minimum period of five years.

If this is acceptable to you could you kindly confirm same
in writing. Also, we will require confirmation in writing
of the agreement of the City to indemnify the Crown
Provincial in relation to the above captioned litigation.

Finally, we enclose herewith the advertisement recently
published in the Burnaby and New Westminster Newspaper of

February 14th, 1990.
