FREEMAN () _ u APR 16 1973 Street to Spruce Park Properties Ltd, Jj Re: Proposed Sale of Portion of Kennedy At the regular Council meeting held on April 9th, 1973 the Council requested further clarification with respect to the above noted matter and we will attempt to do so in this memorandum and the attachments. closing the portion of Kennedy Street and developine the City owned property sed by the developer of the property located immediately to the west of Kennedy associated company of Spruce Park Properties Ltd.), Although this request for a joint development was not approved — see attachment "A" hereto and particularly the underlined section in the City's letter of June 30th, 1971 shown thereon ~ it is nevertheless correct to Say that the proposal to clese Kennedy Street at Lincoln Avenue arose at that time at the request of our Engineering and Planning Departments, As will be seen from attachment "B" — letter from T.F. Roote Ltd. dated August 16th, 1971 ~ the suggestion of a possible joint development was accepted and in the underlined portion of the letter the Council will see that a further meeting was requested to discuss this and the proposed cancellation of Kennedy Street, Nothing further developes in this file until the suggestion that the City should transfer ownership of its property immediately to the east of Kennedy Street (Lot 203) to Meridian Developments Ltd. in exchange for property owned by Meridian Developments in the City's Ecological Area. Attachment "C" is a memorandum from “ir. Pollock dated October 12th, 1972 and the plan that was attached to the memorandum is also shown. This plan, incidentally, is the original sketch plan that was pre- pared in the spring of 1971 when the proposal for the closure of Kennedy Street and the joint development of the property by T.F. Roote Ltd. and the City arose. We have underlined the last sentence in Mr, Pollock's memorandum and the resolution mentioned therein is shown marked on attachment "D" which is our letter of October 18th, 1972 to Meridian Developments solicitor. Attachment "E" is the formal resolution passed by the Council on Gctober 23rd, 1972 which authorized the various property trades with Meridian Developments and the last paragraph will be of particular interest to the Council, The last attachment, attachment "F", shows the two final sub- division plans that have been prepared, one for Spruce Park Properties on the left numbered one and the one for Meridian Developments on the right numbered two. Looking at subdivision plan number two, the area of land shown cross hatched is the portion of Kennedy Street that Council agreed to sell to Meridian Developments last Monday night and it should be partic- ularly noted that this portion of Kennedy Street forms part of the eleven lot subdivision contemplated in the last paragraph of the resolution shown on attachment "E", Spruce Park Properties subdivision - number one on the left of the attachment "F" ~ is a nine lot subdivision and a portion of Kennedy Street that was proposed to be transferred to that company is also shown cross hatched,
