BYLAW NO. 1997 OCT 17 1983

A Bylaw to impose terms and conditions on
encroachments in, or under highways.

WHEREAS, the Municipal Act R.S.8.C. 1979, c. 290 provides that Council. may by
bylaw regulate uses of or involving a highway or portion of it or public place,
and, except under the terms and conditions imposed by Council, a person shal! not
excavate in, cause a nuisance on, encumber, obstruct, injure, foul or damage any
portion of a highway or other public place; ,

NOW THEREFORE the Counci |! otf The Corporation of the City of Port Coquit!am in
open meeting assembled enacts as fo! lows:

No person shall cause or permit alt! or part of a fixture atrached to fands or
improvements to lands that the person owns to project, on over or under all or
part of avhighway other than a highway designated as "arterial" under Section
31(1) of the Highway Act-R.S$.8.C. 1979 c. 167 unless the person first enters into
an agreement with the City in. the form of that. attached as Schedule A.

2. This Bylaw may be cited for all purposes as the "Highway Encroachment Bylaw,
_ 1983, No. 1997",
