Eng., City Engineer Re: Westgate Enterprises Ltd. — Rezoning Application R#15-74 This memorandum is to advise that on Monday, July 15th, 1974 a building permit application was received by the Chief Building Inspector from a representative of Westgate Enterprises Ltd. to con- struct a 76-unit apartment at 2986 Coast Meridian Road. The plans submitted appear to be the plans that were prepared prior to the exten- sive discussions and negotiations which have been continuing between the Developer and the City since February this year. Council is aware that this years Planning & Zoning Committee has been considering on a continuing basis, necessary revisions to the Zoning By-law as it presently relates to RM-l and RM-2 zoning. It is interesting to note that this was first an agenda item at the Planning & Zoning Committee Meeting held Wednesday, Pebruary 5th, 1974. A meeting was held on Wednesday, July 10th, 1974 between Alderman E.W. Mabbett, Alderman P.F. Ranger, the Chief Building Inspector, and the Planning Officer and recommendations for Council's consideration concerning multiple residential zoning are attached. never ee Sait ALM peMscDS geri aN Ara tee TES Section 707 (1) of the Municipal Act states in part “prior to the adoption of a Zoning By-law, sees, OF O£ an amendment to a zoning By-law, .o.., the Council may cause to be withheld the issuance of a building permit for a period of 30 days from the date of the application". In view of the Developer's previous agreement to enter into a Land Use Contract and in view of the amendments to the Zoning By-law respecting multiple residential zoning that are being considered, the Council might wish to consider instructing the Chief Building Inspector to withhold the issuance of a building permit for a period of 30 days from July 15th, 1974. Before this 30 day period has expired the Council might also wish to consider what further action might be appropriate as outlined in Section 707 (2) of the Municipal Act. . . 4 | ry : $ Respect ully sibmitfed.
