When tests carried out as per Articles 6.4.1., 6.4.2. and 6.4.3. for underground tanks equipped with anodes or impressed current indicate that the anodes or impressed current are failing to perform their designated function, these storage cank systems shall be repaired to conform to their original approval standards or replaced. within 30 days. When any repair to an underground petroleum storage tank system or its dispenser is necessary to corxect product loss or suspected product loss, the owner and occupant of the premises shall immediately notify the Fire Chief or an Officer. When the ground around any underground tank is disturbed by an earthquake, tremor or shifting of the earth for any reason which may affect the integrity of the tank, an Officer may require the tank to be tested for leakage or part failure, including all piping. The test is to be carried out to the satisfaction of an Officer. When an underground tank is abandoned, or has been out of service for three years, whichever first occurs: (i) The Fire Chief or an Officer shall be notified in writing. (ii) All flammable liquids and combustible liquids shall be removed from the underground tank, connected piping and dispensing equipment. (iii) The tank shall be removed from the ground and purged of vapours. (iv). The piping shall be removed from the ground or shall be purged of flammable liquids and vapour, and the ends of the piping shall be permanently sealed by capping or plugging. (v) If the soil under and around the storage tank is contaminated with liquid, it shall be replaced with clean fill to a degree acceptable to the Fire Chief or an Officer. When an underground tank is to be removed and not replaced, the Fire Chief or an Officer shall be notified at least three working days prior to the removal of the tank. All used underground tanks removed from the ground shall be destroyed or disposed of in conformance with Subsection 4.10.4 "Reuse and Disposal of Storage Tanks" of the Fire Code. No supplier shall deliver petroleum products to an underground tank, unless the tank and its installation has been approved by an officer as being in compliance with this Bylaw.
