Supreme Court of Canada Justices ruled 8-1 last week the $355 million Oldman River dam — built by the Alberta govern- ment for irrigation and flood uf control — is effectively illegal a because it: was built without a a federal environmental review. Rivers Defence Coalition chairman Pat Moss says the decision clearly states federal Environmental Assessment Review Process (EARP) guidelines have the force of law preteen main arguments why its billion- dollar Kemano Completion Project shouldn’t undergo a full environmental review. *We are really pleased,’’ she said. ‘It’s pretty clear now that the federal government should have done an environmental assessment-of the Kemano pro- ject. , Alcan had in part been argu- ing that the guidelines were drawn up by the federal en- vironment minister without any intention that they become law. The company is appealing last spring’s decision by Federal Court Judge Allison Walsh that overturned the federal cabinet's exemption of Kemano from the EARP guidelines. That ruling also threw out the —"Elitiiiiatitig "one Gf “Alcan’s” tawa setting out how much of the Nechako River's water could be diverted to the hydroelectric generators at Kemano. But the ruling in the Oldman case says the federal govern- ment must do-a_ full en- vironmental assessment before making decisions about projects which may affect the environ- ment. That assessment, says the. decision, must consider socio- economic factors. such as com- munity livelihood and health as well as biological matters. there are environmental effects in areas of federal jurisdiction. The EARP guidelines are only invoked in those cases when a permit from a federal ministry is required for a project to go ahead — when there is a “‘affir- mative. regulatory duty’’. Alcan can be prosecuted if it violates the regulations of, for example, the Department of Fisheries and Oceans, Rich said. But it requires no permits from fisheries or any of the other federal ministries involy- ed, and therefore shouldn't be reviewable, he added. “We are really pleased: "the federal government should have done an en- it's pretty, clear now, that ..,. vironmental assessment of the Kernano project.” _ “Taking more water out of the Nechako will do tremendous damage to the land, waters, fisheries and other resources on ‘which the Indian people of this ‘ area depend for their health and livelihood,” said Carrier-Sekani chief Justa Monk. ‘‘Those risks have never been fully studied by the government or explained to the public.” Alcan officials claim the judgment also limits the jurisdiction of the Department of Fisheries and Oceans to order environmental reviews. Company vice-president Bill” Rich noted the decision says a federal environmental review ‘*The EARP process doesn’t fit the Kemano Completion Project,’ Rich -said. ‘The things that are being done don’t meet the test of requiring the EARP review. My view is that the Oldman case, to the extent that it is comparable, seems to support that.” The Oldman case doesn’t rule on whether the federal govern- ment has the right to circumvent the EARP process. Moss said the Oldman case sets the stage for the Federal Court of Appeal — which is to reconvene on the Kemano ap- peal April 8 — to consider whether or not cabinet has the its own laws. Environmentalists fear water levels in the Nechaka could drop to less than 15 per cent of pre-1950 levels if the project goes ahead. Alcan wants to sell most of the power to B.C. Hydro. Work on a second BC. Hydro transmission line bet- ween here and Kitimat is on hald, and Alcan last year laid off most of its 800 Workers at Kemano following the Walsh decision. ‘*The footprint of this project was put in place in the 1950s,’’ Rich said. ‘“That’s when the Kenney! ‘Dam: was :built;: the reservoir was created, and Kemano was built and Kitimat, the port and the town — everything. It may well be that if you were doing all of that to- day you would need to have a federal EARP review somewhere along the line.’ -“But all that’s been in place for 40 years. All we're doing now is diverting more water and running it through turbines. And none of that triggers EARP.” “Physically, we're digging a tunnel in a mountain, putting in some new generators, and generating some more power.
