SUBJECT: Property Exchange - Dyke Right-of-Way ~ Canadian Forest Products Limited RECOMMENDATION: That the City Clerk be authorized to publish and post the "Notice of Disposition of Real Property" referring to a proposed land exchange between the City and Canadian Forest Products Limited. BACKGROUND AND. COMMENTS As most Council Members are aware the City has engaged for some time now in a series of complicated transactions designed to ensure that the Dyke along the Pitt River is located on tand entirely owned or controlled by the City. [tn dealing. with a smat! section of Dyke adjacent to Canadian Forest Products Limited property at the foot of Coast Meridian Road we have’ now reached the stage where a property exchange can take place. This is being done on a "no cost" basts to either party; the cost of the necessary Subdivision Plan having been part of the Dyke Reconstruction Program. ‘There wild, however, be some Incidental expenses to the City In connection with legal fees and Land Title Office filing fees, etc, One of the unusua! complications in this particular transaction is that Canadian Forest Products Limited want to retain a right of access across the dyke and that firm Is not exactly sure where it would want the access to be located. Accordingly, if the Council are agreeable to proceeding with this transaction; when the final documents are presented to the Council! for approval one of the documents for which the Council's approval will be requested is an agreement stating the terms under which the City would agree to grant a right-of-way at a jiocation to be determined in the future. This has been checked out by our Solicitor and by our Engineering Department and neither can see any problems arising.
