Eng., FILE: PWC CITY OF PORT COQUITLAM - ROGERS CABLE VISION AGREEMENT (Public Works Commitice Mecting of July 19, 1994) That His Worship the Mayor and City Clerk be authorized to execute the attached master agreement between the City of Port Coquitlam and Rogers Cable T.V. Ltd. for the use of City road Right of Way for Rogers Cablevision pipes underground and overhead equipment. At this time the City of Port Coquitlam has no written agreement with Rogers Cablevision for the placement of underground or overhead cablevision equipment within the City road Right of Way. Consequently, Rogers Cablevision has been using hydro poles, telephone poles, hydro ducts and telephone ducts for the cablevision equipment. Also, sometimes Rogers Cable T.V. will install their own independent equipment City road Right of Way on am individual approval from the City basis. However, there is no formal agreement with Rogers Cable T.V. Lid. with respect to insurance and liability, cost to the City for relocating cablevision equipment for road widening purposes, compensation for damage to Cablevision equipment, etc. The attached master agreement has been reviewed by Michael McAllister of McKenzie Murdy and McAllister and is presently being used by the of New Westminster and Matsqui.
