The Municipal Council of The Corporation of the City of Port Coquitlam, in open meeting assembled, enacts as follows: 1. This Bylaw may be cited for all purposes as "Soil Removal Regulation Bylaw, 1993, No. 2827". DEFINITIONS 2. In this bylaw: "City Engineer" means the City Engineer and the Deputy City Engineer appointed by Council. "Removal" includes the extraction, relocation, or movement of soil from land. "Soil" includes earth, sand, gravel, rock, and other substances of which land is composed. APPLICATION 3. This bylaw applies to all land within the City of Port Coquitlam exceyi land designated as agricultural land reserve pursuant to the Agricultural Land Commission Act. PROHIBITIONS 4. No person shall cause or permit the removal of soil from any land except in accordance with this bylaw and except in strict compliance with the terms and conditions of any permit issued pursuant to this bylaw. PERMITS 5. Except as exempted by Section 6, any person who proposes to remove soil from land shall first obtain a permit under this bylaw. PERMIT EXEMPTIONS 6. No permit for the removal of soil is required: (a) where soil is removed by any florist, nurseryman or farmer, for use on the same parcel of land for the purpose of a bona fide business of a florist, nurseryman or farmer, provided that no soil shall be removed below the established grade of any highway that adjoins the land from which the soil is removed, or any highway from which access is provided to the land, FIRST THREE READINGS 2827 (TEM | PAGE Fl
