Deputy City Engineer Rezoning Bylaw No. 2605 - 2380 & 2390 Shang (Public Works Committee Meeting July 17, 1991 Bylaw No. 2605 for the rezoning of 2380 & 2390 Shaughnessy Street, was placed before Council on July 8, 1991 for third reading. Council indicated they were not prepared to go forward until outstanding issues related to the development were settled. These issues included the nonconforming historical encroachment of the basement entrance to 2280 Kelly Avenue and the requirement for a fence along the east side of the lane adjacent to 2280 Kelly Avenue. Committee was told that the Deputy City Engineer met with the Developer, Mr. Renato Della Fanna on July 9, 1991 and the Developer agreed to provide the paved lane and the fence at his cost. The City owns a six metre wide lane on the west side and adjacent to 2280 Kelly Avenue. This lane intersects with a three metre lane to the south of 2280 Kelly Avenue. The proposed development will include the development of the six metre lane and this will make the connection point to the three metre lane very difficult for a vehicle to manuever through. Therefore, in order to improve the turning radius at this intersection, the property owner at 2280. Kelly has agreed to an easement on the southwest comer of his land in favour of the City in trade for a one metre easement along the entire length of the six metre right-of-way adjacent to his property. The City’s right-of-way would remain as long as the lane was required for access to this area. The property owner's right-of-way would remain 23 long as he needed to protect the basement entrance to the house located on the lot at 2580 Keliy. | Public Works Committee felt that this resolved all the outstanding issues and that the Rezoning Bylaw should be now ready for consideration of third reading.
