BACKGROUND: On March 19, 1990 the Municipal Council, while considering Rezoning Application File 5/90 at the corner of Westwood Street and Davies Avenue, approved in principle the designation of the area shown in Drawing No. 1 as Mandatory Development Fermit Area III, The applicant of Rezoning 5/90, has now requested that the properties north of Shaftsbury Avenue, occupied by the Westwood Center be not included within the Mandatory Development Permit Area III (See attached letter). proposed Mandatory Development Permit Area is based on financial considerations. Although the arguments given by the proprietor of the Westwood Center, may be not all that solid, the Westwood Center is a new complex and therefore is unlikely that a Development Permit for this property will be required within the next few years. The site is also covered by a Comprehensive Development Plan that attaches drawings to the zone, for all but the smaller lot at the corner of Lougheed and Westwood. Should a significant departure from the plans contained with the Comprehensive Development Zone for the last phase of development of the Westwood Center be requested by the applicant, then Council could extend the Mandatory Development Permit Area designation to include these properties. Because it is not critical to include the Westwood Center in a Mandatory Development Permit Area at this time, the Planning Department Supports the request from Westlo Financial Corporation.
