_ PROVIDED ALWAYS that, and these presents are issued and entered into upon and
subject to the fallowing stipulations, provisos and conditions, that 1s to say:

1. THAT the Lessee shall and will pay the cent hereby reserved in the manner aforesaid, and
shall and will also pay all charges, taxes, rates and assessments whatsoever which shall during the
said term, be charged upon or payable in respect of the denused .prenises.

2, AND THAT it shali be lawtul for the Commission, of any person therennto authorized by it,
at all reasonable times, during the term by these Presents created, and any renewal or renewals
thereof, to enter upon the said premises and to examine the condition thereot and view the state of
repair, and that the Less « will repair according to notice at its own cost and to the satistaction of
the Commission,

3, AND THAT the Lessee shall not, nor will not during the said terny assign or sublet the said
wremises Or any part thereof without the consent in writing of the Commission thereto being tirst
iad and obtained, such consent to Le subject to such terms and conditions as the Comnussion may
determine.

4. AND THAT the lands and premises hereby demised and leased shall be used for the purpose
of Barge Loading

only, and for na other purpose or purposes whatever,

5, AND THAT the Lessee hereby acknowledges that he has examined the said prenuses and is
aware of the present condition of repair and the Lessee covenants and agrees that he will forthwith
muke any and all necessary repairs, if required by the Commussion, to the said prenises at his own
vost and to the satisfaction of the Cumuimssion.

7, AND TILAT the Lessee shall upon the expiration of sooner determination of this lease in any
other manner except re-entry, ib requited by the Commission, at tie Lessee's expense and to the
satisfaction of the Commission, forthwith remove from the said premises all piles, dolphins, struc-
(ures, erections, equipment, articles, niaterials, effects and things at any time brought or placed
thereon by the Lesace and shall also to the satisfaction of the Commission repair ail and every
daniage and injury occasioned to the said lind by reason of such removal, or in the pertormance
thereat, but the Lessee shall not, hy reason of any action taken or things performed or required
under this clause, be entitled to any compensation whatever; PROVIDED THAT unless required
hy the Cammission, no gourds, chattels, materials, etfects or things shall he removed from the lands

and premises of the Conunission ancl all rent due or ro become due under this lease is fully paid.

8. AND THAT the Lessee further covenants and aprees that i¢ will at its expense post the area
of the Lease ny accordance with the by-laws of the Commission tn force at the tine.

J) ITIS UNRERSTOOD AND AGREED betveen the Parties hereto that if the upland owners
request cancellation of this lease, hat the same may he cancelled by the Commission at the expica-
tion of TWELVE (12) months atter notice in weiting has been given by the Commissioners to
the Lessee hy reyistered mail addressed to the Lessee at its aforesind address and at the eNpiradior
of the said TWELVE (12) months from the date of delivery of the said Notice, this lease shall ipso
facto he cancelled and detersunsd forthwith.

10, AND THAT any assignment by operation of any law of hankruptey or insolvency or any
assignment for the benefit of ereduors of the Lessee of the premises and privileges herchy conferred
shall of itself be a forfeiture of the said prenuses and all rights and privileges hereunder, but no for
feiture hereunder shall be deemed (a attect any rights or damages which may have accrued to the
Commission against the Lessee hy reason of any breach of any of the provisions: herein contained,

tt. AND THAT the Lessee shall not during the term hereof deposit upon the lands hereby
demised or any part thereof any earch or other material for the purpose of reclining, niling-in of
raising the level of any portion ai these lands, without the consent in writing of the Commission
and then only in accordance with such vermis, conditions and regulations as the said Conmssion
may make.

12, AND THAT notwithstanding the rights and privileges of the Lessee herem contained, the
Comission reserves the eight ta geant rigivs-olaway across, Chrongh, under or over any poruon
of the lands herely demised for any purpose whatsoever, au the condition however that the riglitss
of-way so granted shall not unreasonably mteriere with the rights granted by this Indenture, of with
the Lessee’s improvements on the lands hereby dentsed, and in the event that the lussee’s rights

and iniprovements are intertered with, compensation sliall he set at the sole discretion ot the Cont
mission and its decision as to compensation shall be final.
