Borch, City Engineer, Item I Res Apreement between Carlberg Jackson Partners and the City of Port Coquitlam. Attached to this report is a copy of the proposed agreenent between Carlberg Jackson Partners and the City of Port Coquitlam. This agreement hag been reviewed by che City Solicitor, the City Engineer, and the Parks & Recreat« fon Committee. The following revisions to the proposed agreement are recommended for Council's consideration. 1. Description of work should be expanded to include the four approved portions of the project and the approved sites. 2. Article 5A shall have the following added: “Provided, however, that the total fee payable to the architect shall not exceed 745% of the cost of the work", 3. Article 9 - Arbitration.¥o be withdrawn and the following in- serted: "In the case of any dispute arising between the client and the architect as to their respective rights and obligations under this contract, either party hereto, may, at his option, give to the other party notice of such dispute and demand arbitration thereof and the parties may, with respect to the particular matters thea in dispute, agree to submit the same to arbit- ration in accordance with the laws of the Province of British Columbia, provided that if arbitration has not been demanded, either party may proceed to have such disput2 determined before the Courts of the Province of British Columbia".
