Squire then asked Williston if the “escape provisions” of Section 26 could relieve the TEL holder of the contracting out responsibility. Section 26 states: “Tn the process of harvest- ing a crop from the licensed area the Licensee shall pro- vide the opportunity for con- tractors other than the Li- . censee’s own employees or shareholders who own more than one per cent interest to harvest a minimum of thirty per cent of the allowable cut from Crown lands not held under other tenure as set forth in each succeeding Man- agement Working Plan, and where the Minister is satisfied that such contract operation is not feasible either by reason of lack of operators or for other good and sufficient rea- sons the Minister may relieve a Licensee in whole or in part. Williston, in reply to Squire’s question, stated, if cause could be shown by either Union or Management or preferably both, that the application of the clause was harmful to the work force or the community, then there could be no justifiable reason for the enforcement of the provisions of Section 26. Squire then informed the minister that the Union was quite prepared to prove the clause was having a detri- mental effect on the present Union work force and estab- lished contractors. He pointed out that the companies were using the clause to break down Union ‘conditions in the operations. The companies, he stated, were jumping at the chance to lay off their own employees wherever it was possible to have the work done by the lower paid employees of the contractors and sub-contrac- tors. His arguments convinced Williston of the need for fur- ther discussions on the sub- ject with the Regional officers.
