DESCRIPTION: BACKGROUND: ‘The subject site is presently zoned RS~1 and is within the boundary of the Downtown Core, The location is a suitable apartment site and the proposed development conforms to the overall planning objective for the Downtown Core. The development, however, cannot be approved under zoning as the proposed density exceeds that permitted in the highest . apartment zoning (RM~4) in the Zoning Bylaw. In addition relaxation on some of the siting requirements is also required on account of the irregular shape of the site. As a result, a Land Use Contract is proposed.
