During the construction phase — contract administration, ty Ar- chitect shall bea representative of the Client, shall advise and gonsult with him and shall have authority to act on his behalf to thé extent Provided in this agreement, and shall ar all times have aceéss to the Work wherever it is in preparation or progress. All insrylictions to the Contractor shall be forwarded through the Architecf, The Architect shall carry out the general review of thé Work at in- tervals appropriate to the stage of construction whic the Architect considers necessary to determine if the Work is in gerferal conformity with the Contract Documents. However, the Architect shall not be required to make exhaustive or continuous on-dte inspections to check the quality or quantity of the Work. On she basis of the Ar- chitect’s general review of the Work, the Arckitect shall keep the Client informed of the progress and quality af the Work and shall endeavour to guard the Client against defectg/and deficiencies in the Work of the Contractor, but the Architect Shall not be responsible for identifying defects or deficiencies in Ane Work which are not reasonably apparent or visible at the time Sf such general review and which result trom the Contractor's failyfe to carry out the Work in accordance with the Contract Documghts. : The Architect shall noc have contro/or charge of and shall nor be responsible for construction means, ethods, techniques, sequences, or procedures, or for safety precauyions and programs in connection with the Work, nor shall the Architect be responsible for the acts or omissions of the Contractor, $ bcontractors, or any other persons performing any of the Work, Ar for the failure of any of them to carry out the Work in accordgnce with the Contract Documents, The Architect shall derermire the amounts owing to the Contractor based on observations at tHe site and on evaluations of the Contrac- tor’s application for paymént, and shall issue certificates for payment in such amounts, as proyided in the Contract Documents. The issu- ance of a certificate forfpayment shall constitute a representation by the Architect co the Cfient, based on the Architect’s observations at the site as provided ifs paragraph 2.1.16 and on the data comprising the Contractor's applications for payment, that the Work has pro- gressed to the pojht indicated; chat, to the best of the Architect’s knowledge, inforfnation and belief. the quality of the Work is in ac- cordance with the Contract Documents; and that the Contractor is entitled to payfent in the amount certified. Such certification is sub- ject to: (a) general feview and evaluation of the Work as it progresses for genera¥contormiry with the Contract Documents. (b) the results of any subsequent tests required by or performed un- der phe Contract Documents, (c) miyor deviations from the Contract Documents correctable prior tofcompletion, and (d) phy specific qualifications stated in the certificate for payment.
