The Applicant agrees that if the landscaping is not completed pursuant

to paragraph 1 hereto the City may draw upon the Letter of Credit for the full
principal sum and retain all money received until such time ae the landscaping
has been completed in accordance with Appendix i.

If the werks are completed as herein provided, then the depoait shall
be returned to the Applicant.

It is understood and egreed that the inteu. of this Agreement is
that the Applicant shall fully complete the Y-iscaping work required as shown

in the plans and specifications prepared by

approved by the Planning Officer of the City on the

4. The Applicant covenants to save harmless and effectually indemnify

(a) All actions and proceedings costs, damages, expenses, claims and

dewands whatsoever and by whomscever brought by reason af the

installation of the landscaping.

All expenses and costs which may be incurred by reason of the

installation of the landscaping resulting in damage to any property

owned in whole or.in part by the City or which the City by duty

or custom is obliged, directly or indirectly, in any way or to any

degree, to construc’, repair or maintain.
All expenses and costs which may be incurred by reason of liens for
non-payment of labour or materials, workmen's compensation assesa~
ments, unemployment insurance, Federal or Provincial Tax, check-off
and for encroachments owing to mistakes in survey.
5. It is understood and agreed that the City has made no representations,
convenants, warranties, guarantees, promises or agreements (verbal or otherwise)
with the Applicant other than those in this contract.
WHEREVER the singular or the masculine is used throughout this
Indenture, the same shall be construed as meaning the plural or the feminine
or body corporate or politic where the context or the parties hereto so require.

THIS AGREEMENT shall enure to the benefit of and be binding upon the

parties hereto, their respective heirs, executors, administrators and assigns.
