Offers may be made subject to the rezoning of the property to single family, two family and/or apartment zoning designation. Offers should clearly state whether or not they are subject to rezoning, and if Subject to rezoning, should include a plan indicating which areas of the property are proposed for which zoning designation. If an offer is made subject to rezoning, the time for payment of the full balance of the purchase price and completion of the sale shall be extended until 15 days after a zoning amendment bylaw for the property has been adopted. If an offer subject to rezoning is accepted, and the property is not rezoned before December 29th, 1989 the sale agreement shail be terminated and all money paid shall be refunded without interest. Zoning amendments are entirely within the discretion of Council and the City does not warrant or represent that any rezoning will be advanced or adopted. This investigation should include, but not necessarily be limited to, matters such as the state of the City's title to the property, soil stability on the property and in the area, topography, drainage courses, and other matters that may affect the tenderer's use of the land. Information on services to the property may be obtained from the City's Engineering Department. Payment of Development Cost Charges and connection fees will be required. Information on Zoning or other land use matters may be obtained from the City's Planning Department. Further information may be obtained from the undersigned. The highest or any tender will not necessarily be accepted and the City reserves the right to waive minor deficiencies in a bonafide tender received by the closing time.
