(b) ALL other words and expressions in this Agreement, unless the
context otherwise requires, shall have the meaning assigned to
them by the "City of Port Cequitlan Zontny Bylay, 1969, No.
918", as anended or, if not defined therein, by the “Muncipal

Act™ or the “Interpretation Act" of the Province of British
Columbia.

2. The Developer is the Tegistered ower of an estate in fee simple of
ALL AND SINGULAR that certain Parcel or trace of land and Premises
situate, lying and being in the City of Port Coquitlan, ia the Province
of British Columbia, and being pore Particularly known and described as;

14213, New Westninster District

(hereinafter called “the land"),

and development get forth hereia, which Consents are attached hereto,

4& (a) The land, including the surface of water, and any and all
buildings, structures and inpr.-enents erected thereon, there-
over or therein shall be used for the undernoted purposes only
and for no other purposes whatsoever:

Except as othervise provided in this Land Use Contract the
ebove-noted uses shall be pernteted to the limit and extent

this Agreenent in the New Westuinster Land Registry Office as

5. (a) No budlding, structure or improvement shall be sited upon the
land except in compliance with the site plan and particulars set out in
Appendix II herein which contains:

(i) Drawing No. Al entitled Floor Plans - Scheae Two = Front

and Rear Elevations; and
(14) Drawing No. A2 entitled Foundation Plan ~ Scheme Two -
Elevations and Sections

Commercial and Apartnent Building on Harpole Street, Port Coquitiaa, B.c.
for Mr. Bill Rusin® and bearing Job No. 7416.
(b) All construction details shall conform to the provisions of

the applicable portions of the National Building Code of Canada, the
British Columbia Plumbing Code, and the “City of Port Coquitlam Building
and Plunbing Code Administration By-law, 1974, No. 1298",
6. Notwithstanding the provisions of the "City of Port Coquitian Subdiviston
of Land By-2av, 1970, No. 992" the land shall not be subdivided in any manner
whatsoever except as permitted by the Strata Titles Act.
7. No sign or signs shall be erected upon the land or on any buildiag or
structure thereon except as permitted by the "City of Pore Coquttlas Zoning
By-law, 1969, No. 918", as amended, and in accordance with the Provisions
of the “City of Port Coquitlam Sign By-law, 1969, No. 936" as anended, and
all provisions therein relating to signs in the c-4 (Town Sub-Ceatre
Commercial) Zone shall apply to signs herein.
8. Of &streec parking, loading spaces, playground areas, playground
equipment, garbage Pick-up areas, and other facilities and anenities

shall be Provided, located and Constructed in accordance vith Appendix IT

hereto.

9. All buildings and structures shall be constructed strictly in
compliance with and according to the Plans, elevations and Perspective
set out in Appendix IT hereto, provided however that minor alterations
to the plans may be permitted and approved by the Building Inspector,

10. All landscaping, surface treatments, fences and screens shall be

Constructed, located, provided and maintained in compliance with and

according to the plans set out in Appendix II hereto.
