TUE COn OMA UH OF UN GUT G2 PGtt COQUETLAH BY-LAW NO. 1373 A By-law to authorize the City to enter into Land Use Contract No. 11 WHEREAS the "City of Port Coquitlam Zoning By-law, 1969, No. 918" as amended designates certain areas of land within the zones set out therein as "Development Areas"; AND WHEREAS the lands hereinafter described are situate within ‘ao ares so designated; AND WHEREAS the Owner of the ssid lands has made application for a Land Use Contract to authorize works, development, and use some aspects of which are not in conformity with the relevant ‘caty By-laws as the same apply to the zone in which the said lands are situate; AND GHEREAS the Council has given due regard to the following considerations: (a) the promotion of health, safety, convenience and welfare of the public. (>) the prevention of the overcrowding of land, and the preservation of the anerities particular to any zone. , (ce) the securing of adequate light, air and access. (a) the value of the land and the nature of its present and prospective ‘use and occupancy. ; {e) the character of each zone, the character of the buildings already erected and the peculiar suitability of che zone for particular use. conservation of property values. development of areas to promote greater efficiency and the impact of development on present and future public costs. the betterment of the environment. the fulfillment of community goals. the provision of necegsary public apace. and it is deemed desirable to enter inte Land Use Contract No. 11. in the form and to the extent hereinafter provided; NOW THEREFORE the Municfpal Council of The Corporation of ‘the City of Port Coquitlam, in open meeting assembled, enacts as follows: 1. The Council of The Corporation of the City of Porr Coquitlam is hereby authorized and empowered to enter into a Land Use Contract with “ oe SEV Pat LAS intent Ricard Holdings Ltd., 3046 Lougheed Highway, Port Coquitlam, B. C. in the form and to the extent set forth in “Land Use Contract No. 11", which is the Schedule hereto annexed and made paic of this By-law. 2. | The said Land Use Contract No. 11 shall extend to and shall regulate the development and use of the lands described as: 4, Lot 41, District Lot 465, Group One, Plan 25135, New Westminster District, Except Part Subdivided by By-law Plan . Lots 4-10, inclusive, Block Ona, District Lot 465, Group One, Plan 2364, New Weatninster District. All that Portion of Perth Street of District Lot 465, Group Qne, New Westminster District. as shown dedicated on Registered Plan 2364 included within the green outline on a By~law Plan prepared by V.C. Goudal, B.C.L.S., and dated March 11th, 1975, a copy of which said Plan was attached to and made part of the "Perth Street Plan 25135 Highway Exchange By-law, 1975, No. 1368" of The Corporation of the City of Port Coquitlam. (Now known as Parcel , (By~law Plaa ), District Lot 465, Group One, New Westminster District, Plan 2364.) 3. Land Use Contract No. 11 shall have the force and effect of a restrictive covenant running with the land described in Section 2 hereof and shall be registered in the New Westminster Land Registry Office by the City. 4, This By-law may be cited for all purposes as the "Land Use Contract No. 11 Authorization By-law, 1975, No. 1373". ; Read a firet time by the Municipal Council this Twenty-first day of épril, 1975. , , Read a second time by the Municipal Council this Twenty-first day of April, 1975.
