dD. Section 539 of the Municipal Act, R.S.B.C. 1979, 2906 empowers the Council of the City to grant the easement set out in this Agreement; NOW THEREFORE THE CITY AND THE GRANTEE CONVENANT AND AGREE AS FOLLOWS: 1. In consideration of the sum of $250.00 and other valuable consideration, the receipt and sufficiency of which is acknowledged by the City, the City hereby grants unto the Grantee an easement over the Easement Area defined in Section 2 for a period of 25 years from the date of this Agreement, subject to the terms and conditions of this Agreement. 2. The Easement Area is that portion of the Servient Tenement shown outlined heavily in black on the explanatory plan prepared by D. Dyck, B.C.L.S., on the 12th day of November, 1987 and deposited in the New Westminster Land Title Office under No. , annexed to and forming part of this Agreement. 3. The Grantee may use the Easement Area for the sole purpose of outdoor storage of materials of any kind other than refuse and scrap metal, and for that purpose may at all times enter upon, use, maintain, repair, enjoy, occupy, pass and repass along the easement.
