SUBJECT: Floodplain Restrictive Covenant - 3160 Westwood Street

That His Worship, the Mayor and the City Clerk be authorized to execute the attached
Floodplain Restrictive Covenant over the following lots:

1, "Parcel C", DL380, Group 1, NWD, Reference Plan 63778.
2. Part 1.93 acres more or less (Statutory Right-of-way Plan 908) DL380, Group 1, NWD.

One of the requirements for the two lot subdivision located south of the CPR main tracks and
east of Westwoud Street is to meet the Ministry of Environmenit Floodplain requirements.

As shown on the attached Restrictive Covenant, the Ministry of Environment. requires a
minimum subfloor elevation of nine metres above sea level and requires that the owner save the
Province and the Municipality harmless in the event of floods.
