Latecomer Charge Waiver Agreement
2349/65 Whyte Avenue

RECOMMENDATION:

At the request of and pursuant to the Agreement with FE. & R. Development
Corp. dated the lst day of February, 1991, BE IT RESOLVED that the works and
services described foreaaid Agreement and installed or to be installed
by the said E, Development Corp. in connection with the development of
the lands described as: -

Lots 4, 5, 6, and 7, Block 2, D.L. 373, Group 1,
New Westminster District, Plan 1213

are hereby conclusively deemed to be for the sole benefit of those lands and
that none of the cost of providing the said works and services shall
constitute “excess or extended services" as defined by Section 990 of the
Municipal Act.

| AND THAT the aforesaid Agreement be and the same is hereby approved and
that the Mayor and City Clerk are authorized to Sign the same on behalf of the
City and to affix the Corporate seal thereto.

BACKGROUND AND COMMENTS:

The Agreement that would: be approved by passage of the above noted
resolution followa the City's .standard form for such Agreements and is
available for perusal in the Clerk's office. |
