Director of Planning 3450 Coast Meridian Road Development Variance Permit Amendment Planning Department File No. 13/90 It is recommended that Council ngt approve this proposed amendment to Development Variance Permit No. 13/89. ; a ee The applicant is proposing to construct an 18 unit townhouse complex at 3450 Coast Meridian Road. On December 18th, 1989 the Municipal Council approved for this project a relaxation of sideyard setbacks from 7.5 meters (24.60 ft.) to 6 meters (19.69 ft). The applicant is now requesting an additional relaxation of a further 5'-4", as the proposed building currently design cannot be sited without encroaching on the 6 meters (19.69 ft) reduced sideyard approved by Council. DISCUSSION: The additional setback is required in order to allow for the building balconies to be structured with columns supporting their outer edge. The sideyard relaxation, if approved, will reduce the sideyard from the bylaw requirements of 7,5 meters (24.60 ft.) to 4.46 metres (14'-8"). This additional relaxation would not be required if the baiconies are built in cantilever. The building is currently under construction, and the foundation forms are in. place; the applicant has indicated that it was not their intention to request additional relaxation, but it is simply a case of an error of interpretation of the bylaw on there part. The applicant has indicated that they would prefer not to redesign the balconies as the cost of having the balconies in cantilever would be higher and may delay the construction.
