DISCUSSION: Approval of this rezoning and development permit application will enable the construction of a new multi-family building in the Downtown Apartment District. The proposed building presents an innovative combination of ground-oriented ''townhouse''-style units and standard apartment units. In order to accentuate the elevations, peaked roof structures are placed over certain portions of the building. These roof structures result in the overall height being exceeded by approximately 0.3 to 1.3 metres at various points around the building (from natural grade). Since the height variance being requested is relatively minor, and the roof structures result in a more attractive building, the Planning Department supports the relaxation. All setbacks, parking, and indoor and outdoor recreation areas are provided in accordance with the Zoning Bylaw. The applicant has been advised of concerns expressed by the R.C.M.P. and has made minor amendments to the plan to address those concerns. As this is the first of Four buildings proposed for the site, it is recommended that a "No-Build" Restrictive Covenant be registered against the remaining undeveloped portion of the property to ensure that the development will only proceed upon City approval of building design. The future buildings will be subject to development permits to ensure compatibility with surroundings, adequate landscaping, and high quality design. The proposed development conforms with most zoning regulations and the design guidelines in the 0.C.P.
