Latecomer Charge Waiver Agreement

RECOMMENDATION:

At the request of and pursuant to the Agreement with Indalex Holdings
(B.C.) Ltd. on the 18th day of June, 1991, BE IT RESOLVED that the works and
services described in the aforesaid Agreement and installed or to be installed
by the said Indalex Holdings (B.C.) Ltd. in connection with the development of
the lands described as:

are hereby conclusively deemed to be for the sole benefit of those lands and
that. none of ‘the cost of providing the said works and services shail
constitute "excess or extended services” as defined by Section 990 of the
Municipal Act. oo

AND THAT the aforesaid Agreement be and the same is hereby approved and
that the Mayor and City Clerk are authorized to sign the same on behalf of the
City and. to affix the Corporate seal thereto.
